Terms and Conditions
Use of the Website —By accessing the website, you warrant and represent to Gator-RC that you are legally entitled to do so and to make use of information made available via the website. You must be at least 18 years old to have our permission to use this site. Our policy is that we do not knowingly collect, use or disclose Personally Identifiable Information about visitors under 18 years of age. If you are the parent or guardian of a minor under 18 years of age and believe that they have disclosed personally identifiable information to us, please contact us so that we may delete the minor's information and cancel any unverified orders.
Trademarks— The trademarks, names, logos and service marks (collectively “trademarks”) displayed on this website are registered and unregistered trademarks of Gator-RC. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of Gator-RC.
External links— External links may be provided for your convenience, but they are beyond the control of Gator-RC and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk.
Order Delays— Orders placed using credit cards and/or Paypal may be subject to delays without notice including but not limited to the following reasons: missing security code, international credit card that the bank issuer does not support address verification, incorrect billing address is entered, or Paypal account is unverified and/or address is unconfirmed. If verification is needed, Gator-RC's order processing department will inquire for documentation to verify that the card holder has authorized the charge and to prevent fraudulent orders including but not limited to a digital copy of: the same credit card used (all digits can be blocked but last 4 digits must be visible), identification card of the card issuer, and a utility bill (or bills that are sent to the billing address directed to the card issuer). All of the requested information will remain confidential and will not be shared with a third party.
Warranties— All products ordered from Gator-RC come with a 30-Day Warranty unless otherwise stated. Please note that some products are warrantied exclusively by the manufacturer. Your warranty begins the moment you receive your package. If an item breaks or malfunctions under normal use, you may submit a request for a Return Merchandise Authorization (RMA) number within 30 days of receipt. Once the RMA number has been issued, you will have 15 days to take the item to a post office, UPS store, or FedEx Store to have it returned to our facilities or the RMA code will expire. Unless stated, freight charges will not be refunded. The customer is responsible for insured shipping back to our facilities. All warranty parts or items may only be replaced once. All warranty parts or items will be shipped ground, they cannot be expedited.
The 30-Day Warranty is null and void if the item has been altered or abused (i.e. mishandling the product, modifying or removing parts, dropping or subjecting it to any sort of impact, and/or disassembling the item). Unless instructed to do so specifically by a Gator-RC representative, do not do modify your product in any way before returning.
Any damage sustained during use is not covered under the Gator-RC 30-Day Warranty unless damage can be proven to be due to manufacturer's error. By using these products, you agree that Gator-RC WILL NOT be held responsible for any injuries or damages due to the user's negligence and/or lack of knowledge of the product. The user shall determine the suitability of the product for his/her intended use and shall assume all risk and liability in connection therewith. This pertains and applies to all items sold by Gator-RC.
Gator-RC will make every effort possible to understand that each case is unique and will try to assist you in the best way possible. Please understand that this is a hobby and that you may at times be required to do some modifications that may include but is not limited to cutting, gluing, soldering, or other types of adjustments to your item before it can be operated.
Disclaimer of liability —Gator-RC shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, products and items purchases, used and operated from this website, you or your company’s personal information or material and information transmitted over our system. In particular, neither Gator-RC nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.
Conflict of terms— If there is a conflict or contradiction between the provisions of these website terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the website shall prevail in respect of your use of the relevant section or module of the website.
Severability— Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to being void, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as void and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect.
